OHA issues 2007 Annual Report.
OHA announces, in this notice, procedures for issuing partial refunds amounting to approximately 90% of the money due each eligible claimant in the crude oil supplemental refund proceeding, with the exception of specified claimants whose refunds are currently being challenged by third parties in pending litigation. Comments received from the public and referenced in the notice can be found here.
Physician Panel Appeals. Congress amended the Energy Employees Occupational Illness Compensation Program Act. The amendment repealed Subpart D and created a new compensation program administered by the Department of Labor (DOL). Information on the DOL program may be found here.
The Office of Hearings and Appeals granted in part an appeal by ChevronTexaco from a June 2002 determination issued by the Principal Deputy Assistant Secretary for Fossil Energy (PDSFE). The determination concerned the Elk Hills oil field (Naval Petroleum Reserve No. 1), which Chevron and DOE operated as unitized property prior to the federal government’s 1998 sale of its interest. The June 2002 determination established the final percentage participations for the Stevens Zone, the largest producing zone in the Unit. On appeal, ChevronTexaco challenged the methodology for a portion of the calculation. The Decision and Order sets forth the governing principle and remands the matter for a new determination that is appealable by ChevronTexaco. The Decision and Order may be found here.

OHA is now considering worker advocacy appeals under the new "Physician Panel Rule," issued under the Energy Employees Occupational Illness Compensation Program Act of 2000. Secretary Abraham has issued a new Delegation of Authority to the Director
of the Office of Hearings and Appeals that updates and consolidates all
previously issued Secretarial delegations. (December 6, 2001)

OHA issues decision to Atlas
Corporation, upholding a determination by the Environmental Restoration
Division of the Albuquerque Operations Office to disallow certain claimed mine
remediation costs under 10 C.F.R. Part 765. The OHA rejected Atlas' contention
that it incurred $1 million in mine remediation costs when it transferred the
right to salvage to a contractor in exchange for decommissioning work.
